a middle school teacher takes his own life just days after being accused of an inappropriate relationship with a student. good evening everyone i'm frank somerville. >> and i'm julie haener. an east bay school community that is struggling to deal with the recent arrest of a well liked teacher is tonight struggling to deal with his death. heather holmes is live at albany middle school where shock has again hit campus. heather. >> reporter: as you can see candles they burn tonight in memory of the once popular teacher who's fall from grace came last week after he was

arrested for allegedly molesting a former student. this is not the ending he deserved read a note left outside of the albany middle school but it is the last chapter of james azumizaki. >> it's kind of tragic but we don't know what to say about it. >> reporter: just last wednesday, the trusted educator and volleyball and basketball coach was arrested at his home in albany in suspicion of having an inappropriate relationship with a student under 14. >> the allegations didn't sound like him. >> reporter: azumizaki posted bail the next day but charged had not been filed. but this morning, the investigation took a turn. >> reporter: we >> reporter: -- >> we got a call this morning for an alleged suicide.

he did leave some correspondence behind. i don't want to get into the details of it but he did leave some correspondence behind. >> reporter: today he discussed the teacher's suicide. >> we don't know what to think about that. in a way it could mean guilt, in another he could have been so -- distraught. we don't know what to think about it. heather holmes. the body of one of two fishermen who went missing off the coast was discovered this evening. family members say they found the body off the rocks of pigeon point after the coast guard called off it's search.

63-year-old carl dang disappeared yesterday. two other men made it to shore safely. an amtrak train out of oakland derailed this afternoon after it was hit by a big rig in the central valley. 42 people were taken to hospitals complaining of injury. amtrak says the train was carrying 169 passengers and four crew members from oakland to bakers field when the truck pushed through the crossing bars and hit the train. passengers on the train were terrified and we spoke to one woman on board who described a chaotic scene. >> you couldn't see anything it was just all dusty and you know you're breathing in all that dirt. and you know people start coughing and i mean screaming, crying. and it was horrible. >> reporter: all of the injuries from today's crash were said to be minor. four years ago at this same

location 33 people were injured when an amtrak train was struck by a truck carrying lemons. we will go live for an update on theinvestigation that is still under way at this hour. about three hours after today's crash there was a second incident involving a train not far away. investigators say a hay truck was too close to a truck as the freight train went by and that the train clipped the truck. in this case the train did not derail. berkeley police say an elderly woman who was driving under the influence struck a pedestrian sending him to the hospital with serious injuries. investigators say 83-year-old mary lou cardova was arrested of dui causing bodily injury. she hit an oakland man near the uc berkeley campus at around 8:30 last night. the 34-year-old victim remains in critical condition tonight. the 83-year-old cardova was booked into the berkeley jail.

an accident involving a school bus shut down a portion of highway 17 this evening and sent one man to the hospital. that crash happened shortly before 5:00 tonight. there were no children on board the bus at the time. it collided with a penske band near mount herman road. we have developing news out of oakland tonight where police are investigating a homicide. at least three people were hit by gunfire including a 14-year- old girl. the shooting happened on mcarthur and 90th just after 9:00 this evening. the mother of the teenager said they were driving through the area when a bullet came through their car and struck her daughter in the leg. police say they found the body of a man inside a car that was riddled with bullets. a third person struck by gunfire was taken to the hospital. a high profile murder trial got under way today in alameda

county superior court. defendant jezelle esteban is accused of killing her friend michelle le. prosecutors contend the murder was premeditated and fueled with jealousy and hatred. the brother of michelle le embraced friends and supporters after opening statements. >> he's having a very difficult time with the first presentation like the rest of the family. >> reporter: cameras were not permitted inside the courtroom where the bones of le were presented. in court today both sides described esteban as a woman consumed with jealousy and hatred for le. the defense says it was a crime of passion. the defense says prosecutors can't prove first or second degree murder but today prosecutors set out to prove

motive and premeditation. they shared one conversation during which esteban accused of meresiban of harboring feeling for le and threatening both saying you will be honest about le or i will take your life and hers. today scott meresigan testified that he and le were just friends but that esteban was convinced that the two were having a sexual relationship. esteban once sent meresigan a text saying that he had picked a wore over his family. >> we're just here for michelle. the man accused of opening fire inside a bay area nursing school appears in court. his outburst right in front of the judge. on this first monday of october the u.s. supreme court

opened its new term of the case involving human rights. the court will decide if federal courts have jurisdiction to hear lawsuits against corporations accused of human rights accuses over seas. at least two justices questioned why the case was being considered in this country. a decision is expected by spring. the supreme court has 49 appeals on its docket. but is expected to consider as many as three dozen more cases. the justices are expected to decide next month whether to take up same-sex marriage. they could hear one or two possible cases. there's prop eight, the california ban on california marriage and the federal defense of marriage act which denies same-sex couples the same federal benefits as hetero sexual couples. macy's is looking forward to the holiday shopping season. the retail giant says it plans to hire 80,000 seasonal workers that's a 2-1/2% increase. most of the work will be part time. the department store chain says the seasonal help will work at

macy's and blomingdale online centers and distribution facilities. on wall street it was a mixed monday. the dow gained 77 points but the nasdaq dropped two. this came after a report showed manufacturing grew last month for the first time in four months. the family of a missing s era toga man is asking for help in locating him. they said no one has heard from eric dean garcia since he left a friend's home near downtown san jose on september 18th. garcia is 32 years old. he's described as 5'10", about 350 pounds with a harley davidson symbol tattooed on the back of his head. anyone with information is asked to contact police. the a's are just one out away from clenching a wild card spot and they could still win their division.

today's hot dry weather helped fuel a fast moving fire that destroyed three homes in sonoma county. it started late this afternoon right next to highway 116. not far from stoney point road and highway 101 near catady. ken wayne is there tonight and tells us there was a massive response from firefighters. >> reporter: firefighters are still on the scene mopping up making sure there are no hot spots. everyone though three homes were destroyed. firefighters say this could have been much worse. the call came in around 5:00 p.m. the fire started on the south side of highway 116 and quickly jumped the highway and started burning near homes on the north side. firefighters say a five to 7- mile an hour wind started spot fires a half mile ahead of the

main fire and threatened to burn to stoney point road and all the way to highway 101. >> ambers are getting through the structures and landing on the grass and starting new spot fires. >> reporter: three homes are now reduced to rubble. an outbuilding and five homes destroyed but no injuries. all animals expect for three chickens survived. >> i tried to bring the water down here, but there was no water. just get the animals and make sure we got out. >> reporter: one couple was set to get married on friday. alan long says there was little time to react. the fire was just too fast. >> in a matter of a minute it went from there down there and around. >> reporter: four aircrafts, 15 engines and dozens of firefighters responded and had the fire out in about an hour. >> you want to hit it hard early and what you don't need send away and we needed everything today. >> reporter: calfire says this is a reminder of just how high the fire danger is right now.

the cause of this fire is under investigation. live in sonoma county, ken wayne, ktvu news. and in seven minutes, vallejo's mayor speaking out about an an arson attack that targeted his office. what he says he's most concerned about? new at 10:00, san rafael moved through with a very strict smoking ban. the ban would ban smoking in parks, and duplexes or multi family residences. smokers could light up while walking and in especially designated smoking areas. we have new information about yesterday's freeway shooting in belmont that injured three people. someone traveling southbound on highway 101 opened fire on a dodge charger which then crashed near the holly street exit. investigators now say the shooter was targeting that charger. they say there may have been trouble between the two vehicles as far back as highway 92. one of the victims is still

hospitalized. police are hoping to locate any witnesses to that incident. latino immigrants hope governor brown would take a harder stance on immigration. the governor approved a bill that allows young immigrants with a work permit to get a driver's license. but legal experts say people with a work permit already qualify for a license. immigration advocates say they are disappointed that brown rejected two other bills for domestic worker rights and prevent deportation for minor crimes. president brown has signed the most bills than any previous governor. he has now signed a total of 12,744 bills. that includes his time as governor. ronald reagan 1,276 during their eight year tenures. it's the first of three

opportunities voters have to see president obama and romney face to face before the november election. ken pritchett tells us both campaigns are trying to manage expectations even before the candidates take the stage. >> reporter: if you listen to the romney campaign they're candidate has a tough road at the university of denver. >> president obama, he's a very gifted speaker. the man has been on the national stage for many years he's an experienced debater. >> reporter: but romney has extensive debater. >> no, governor romney he's a good debater. i'm just okay. >> it is a flurry of unusual compliments, but who's winning the battle to lower expectations? >> i think actually president obama is in part because it's partly true. he's not been a good debater so he has a better argument. >> reporter: but u.s. political science professor cook says the

upcoming election. that is more than 20% from 2008. the hispanic research says that the turn out is usually smaller than that of whites and african americans about 50%. that could be because eligible latino voters are younger and fewer younger people vote. and it was a hot day today. the hottest day of the week for sure. and certainly the hottest day in the last month or so. today was 101 in santa rosa that was the hot spot. 100 in livermore. 90 in hayward. things are going to cool down but it's a slow cool down especially starting tomorrow. how do i know this? look at the temperatures outside. 72degrees right now in downtown san francisco. no fog in site. 76 in concord. almost 80 degrees right now. it's coming up on 10:30 it's almost 80 degrees in san jose right now. with that said you know tomorrow is going to be another hot one.

when i come back we'll have the forecast highs and we're going to talk about the cooling trend that is coming. the fog is not in site right now but it is coming back here at 10:45. the search is now for two thieves that used pick axes to rob a museum of an estimated $2 million. the heist happened last friday afternoon at the california mining and minerals museum in mariposa. at one point the thieves try to get a nearly 14-pound gold nugget setting off an

investigators in vallejo confirmed that a weekend fire at the law office of davis is indeed a case of arson. as noelle walker reports, the investigation is on to find out who targeted an official. >> when mayor davis' office went up in flames -- >> disbelief. i'm not fearful for my life. i am concerned for my family. i have written threats, verbal threats. telephone threats but none have risen to the level of this type of dangerous criminal conduct. >> reporter: today the fire chief confirmed the two alarm fire that happened here on saturday morning was no accident. >> we have confirmed that it

continuing coverage now of that amtrak derailment today in kings county. tonight crews are working to fix the tracks and get the wrecked train out of the area. malory hoff is near the site. >> reporter: there's workers trying frankicly to reopen this track. i want you to take a look behind me you can see the train in the distance behind me. it appears the crane is setting the train back on the tracks. but workers tell me at least 100 feet of trail still needs to be repaired before they can reopen the track. two passengers reflexed on what they experienced on their way out of town. >> i was just shocked. all i felt was shaking. >> reporter: amtrak trains and freight trains cannot travel between bakers field. but some passengers in the

accident say they won't be riding on a train any time soon. >> i don't want to get on any more trains. i don't even want to go home. >> reporter: the rails are owned by santa fe. about 600 feet away, chp continues to investigate. the trailer that hit the train sit on it side. >> he was trying to beat the train, when he seen that he couldn't beat the train he pressed on the brake and it didn't stop. >> both the arms were down and the lights were flashing at the time. so all the safety measures appeared to have been in place at the time of the accident. a pleasanthill restaurant is closed indefinitely after a car crashed through the front window. it happened at the zen restaurant during the rush hour. authorities say the driver of a lexus crash into the dining

area. a few people were hurt but the injuries were not serious. one witness told us the driver was elderly. investigators are looking into what caused the crash as inspectors survey the damage to the building. the accused gunman in the oikos university shooting appeared in court today. we hear about an outburst during the hearing and why some of the former students will have to come face to face with him once again. >> reporter: a very intense looking goh sat, his eyes at times darting. during the hearing he stood up and said, i have a motion. his public defender did file a motion regarding goh's mental state. >> he will be assessed by a psychiatrist or psychologist to determine whether he is competent to stand trial. >> reporter: goh faces attempted murder and murder

charges. the victims were former classmates and a receptionist. authorities believe he was angry about a tuition refund. >> reporter: the doors at oikos are kept locked now. the classroom that became a killing field is no longer used by the nursing program. the nine students who remain are in their final term. >> it's just not easy. it's never going to be forgotten it's just going to be in the past i think a little bit. every time something happens like colorado we may have to talk. >> reporter: the school has received only a provisional accreditation. many of the current students may be called as witnesses if and when goh's case goes to trial. >> they want to become lvns and they want to finish and they want to go on. >> reporter: goh is due back in court after his evaluation by mental health specialists.

in oakland, rob roth, ktvu. the federal aviation administration is investigating two cases where seats came off the tracks. the seats were removed and reinstalled recently during maintenance. the american express credit card company reported today it will be refunding customers. the refund comes after a government investigation into charges american express illegally charged late fees, discriminated against some clients and lied about rewards. the company also agreed to pay almost $28 million in fines to regulators including the consumer financial protection bureau. fed chairman ben bernanke today defended policies used to stimulate the economy. he listed other thing that is can be done. >> such as putting the federal budget on a sustainable path.

five years. president obama today announced plans to visit kern county next week to accomplish the cesar chavez national monument. the cesar chavez national monument will be in the community of keen where chavez once lived. it's also the current location of the national office for the united farmers union. the national monument would preserve chavez legacy of giving a voice to workers. the president is creating that monument through a special executive order. he was going 40 miles per hour on a skateboard, the accident when a deer crossed his path and more of this video that has now gone viral. >> and i'm back here in just a few minutes, we're going to take a look at the fog and how soon it'll be before it gets here. i'll let

the san m ateo union school district says hackers got into their system. the hackers did not compromise any personal information of students. the hackers were using the computers of several innocent parties to try to steal information of the fbi and cia. >> we're told that our fire wall was not breeched. they did get to our server. they used it to cover their tracks. >> reporter: since there was no breech, the district has been asked to leave the server up and running in an attempt to track the hackers. honda is recalling 600,000 cars with faulty steering notices. the recall is for v6 hondas

from 2003 to 2007. only one fire has been reported and no injuries or crashes. the car maker says it will replace the hoses for free but won't actually have the parts until early next year. anyone suspecting a leak should take their accord to a dealer for inspection. anthem blue cross -- it must also offer them each one year of credit monitoring. they must also pay the state $150,000. anthem blue cross did not admit any wrong doing in the settlement. in news of the world in afghanistan, three americans were killed in a suicide attack in the city of host. 16 afghan civilians and police officers did die.

the suicide bomber road on a bicycle. the taliban claimed responsible. in hong kong officials say 36 people died when a chartered passenger boat collided with a ferry in the harbor. the stern of the charter boat ended up under water. more than 100 people were rescued. many of them were suffering from hypotherima. and the russian leader pressed zuckerberg to give out plans to lure away russian computer programmers and instead build a research center in moscow. zuckerberg gave him a t-shirt and told him he has no plans to expand in russia. elisa myer has given birth to a baby boy. she gave birth late last night one week before her october 7th due date. myers says she will work from home for a short time but actually plans to return to yahoo headquarters in one to

new video tonight from contra costa county where a fire broke out in the north concord industrial park area shortly before 9:00. a battalion chief tells us a huge pile of uniforms burned at the aramark facility. the uniforms were outside in a pile estimated 20 feet by 40 feet apparently waiting to be washed. the flames did not spread inside the facility. at this point fire officials say the cause of the fire is not known. if you plan on shopping in san francisco, better bring your own bag or there'll be a price to pay. a new ordnance is expanding the ban on single use bags to all retailers accept for restaurants. now if you want the store to provide a bag at all it's required to charge a minimum of 10-cents. >> i was like, heck no, i don't

want to buy a bag for 10-cents give me a bag. like how we've always been doing it, you know what i mean. it's annoying, it's messing up the flow. >> reporter: retailers who get caught trying to get around the bag ban face fines ranging from $100 for the first offense all the way up to $500. next year the ban will includes restaurants as well. today's triple digit heat had many people seeking relief at the coast. ktvu's matt keller is live in santa cruz with many people disappointed when they arrived. >> reporter: normally when you get here you neat a jacket. many expected that when they arrived but it was hotter here than it was there. >> reporter: today, it wasn't enough. >> >> it's definitely really hot in here. >> our hottest day of the year definitely. >> reporter: workers say it was even too hot to sit on the

deck. normal temperatures are in the mid-70s. >> i noticed some folks were trying to seek out shade and were wondering where they could go park their car that they would be out of the sun. >> reporter: the homeless center put out a warning. jay has been homeless since february and he said last week he was too concerned about being too hot at night. >> i will probably just sleep in a t-shirt. where as i've been putting everything i have on. >> reporter: several people came to the boardwalk hoping to cool off but it was a weird day. >> we put our window down and it was hotter than it was in san jose. >> reporter: take a look at my screen app, san jose was at 93 degrees, santa cruz at 100 degrees. that caught many by surprise. >> when we come here it's usually less than 60 degrees. right now we were surprised because we got here, when we

got here it was 102 degrees. it was crazy. >> reporter: here's your current temperature, 68 degrees right now in santa cruz. that's normally considered a hot day during the normal time of the year here in santa cruz. they're expecting temperatures tomorrow to be cooler compared to today. matt keller, ktvu channel 2 news. and in san jose today, some children got to beat the heat playing in fountains but at some point, the sun stops being a bother and becoming dangerous. cooling centers opened when temperatures jumped up. and there are plans for it to remain open during the week. it's warm out there right now. we talked about it earlier it's 77 degrees in san jose right now so you know it's going to be pretty warm again or hot tomorrow. we're tending for a bit of -- we're trending for a bit of a cooling trend for the next few days but it's a slow one.

i think we will definitely see a cooling trend. 97 in napa, 101 in san jose, that was the hot spot. we the did get a record on kentfield. these are the overnight lows. 55 in hayward. if this was in august or june with the longest days boy we'd be doing very warm overnight lows. fog it's offshore, if it everyone shows up at all. the model kind of keeps it awarden. the model is going to tweak it. for the most part tomorrow is another hot day you know that because this dark purple color those are hundreds seeping back. the marine layer is going to stretch out. you know what that means. not going to stretch out tomorrow it's going to stretch out on wednesday, thursday and into friday. that will be significant cooling. the forecast as we go through the next couple of days will be for a cooling trend.

you got nowhere to go, right. there's not going to be a heating trend at this point. temperatures are going to trend down. temperatures are going to come down a little bit. you will notice the fog most likely on wednesday. the forecast, daytime highs tomorrow still high. notice richmond, 78 degrees. 80degrees in sausalito, 83 in hayward. it's not a spare the air day but you're going to have above what you would like it to be. so just be aware of that. 89degrees for your forecast highs in santa cruz. 91 in wood side. so another warm day. no advisory tomorrow, no spare the air day. your bay area weekend is going to pop into view here and you're going to see that temperatures are cooler. those look more like what you would expect for october. you talked about it in the earlier newscast. so fortunate that we don't have
